NSW:Man pleads guilty to Mudgee teen's murder

SYDNEY, Aug 5 AAP - A man has pleaded guilty to murdering 19-year-old Michelle Morrissey
in her home in the central western NSW town of Mudgee.

Luke John Cotterill, 19, of Londonderry, entered the plea in the NSW Supreme Court
in Sydney on Friday.

He also admitted to a charge of escaping lawful custody arising from an attempt to
flee while being transported from Bathurst Correctional Complex to Sydney's Silverwater
jail.

Cotterill was wounded in the arm, hip and left leg when one of his guards opened fire.

Corrective Services said at the time that Cotterill was running away from a prison van.

The incident, on April 3 last year, occurred days after his arrest over the murder.

Ms Morrissey, who worked as a receptionist at a local real estate agency, was found
dead at the home she shared with her mother in Cox Street, Mudgee, on March 27, 2010.

Her boyfriend discovered her body.

Detectives indicated she had been stabbed to death and a knife was found near the home
during the investigation.

Her boss, Tim O'Brien, described her as a "bright and bubbly" young woman.

Cotterill's matter was adjourned to October 7 for a sentencing hearing.

Jobs (SYDNEY)

Figures out today show Australia's unemployment rate has jumped to a seasonally adjusted
5.3 per cent in July .. compared with an unrevised 5.1 per cent in June.

The Australian Bureau of Statistics says total employment rose by 23-thousand-500 to
11.23 million in July .. seasonally adjusted.

Full-time employment fell by four-thousand-200 to 7.86 million in the month .. while
part-time employment was up by 27-thousand-700 to 3.36 million.

The forecast had been for total employment to have risen by 20-thousand .. but for
unemployment to be steady at 5.1 per cent.

Poll10 Broadband (CANBERRA)

The federal government's national broadband network will be able to provide speeds
of one gigabit per second .. that's 10 times faster than originally planned.

NBN Co chief executive MIKE QUIGLEY announced the turbo-charged capacity .. following
consultations with broadband retailers.

Communications Minister STEPHEN CONROY says the gigabit broadband speeds would benefit
businesses who required greater bandwidth for video conferencing.

Senator CONROY is with Prime Minister JULIA GILLARD in Tasmania .. where the NBN Co
is rolling out the 43-billion-dollar network.



Poll10 Budget (CANBERRA)

The coalition will today ask the Australian Federal Police to investigate how a confidential
analysis of its planned budget savings was leaked from Treasury.

A Sydney newspaper revealed the document .. which suggests the coalition overestimated
by 800 million dollars the amount it would save by scrapping Labor's national broadband
network.

The coalition is refusing to submit 20 policies for costing .. until the source of
the leak is investigated.

Labor campaign spokesman CHRIS BOWEN says it's a pathetic stunt and the opposition
will do anything to avoid economic scrutiny.



Poll10 Economy (CANBERRA)

Federal Labor has rejected Reserve Bank director WARWICK MCKIBBIN'S claim that the
government didn't save 200 thousand jobs through its stimulus spending at the height of
the global financial crisis.

Mr MCKIBBIN says fiscal policy couldn't have created the jobs because it was relatively
small at the time.

But Labor campaign spokesman CHRIS BOWEN says the Treasury analysis is clear .. the
stimulus saved 200 thousand jobs .. and that's a conservative estimate.



Poll10 Tax (CANBERRA)

Opposition Leader TONY ABBOTT is using a school on Sydney's north shore to ram home
the coalition message that billions of dollars of stimulus money has been wasted by Labor.

He also says .. if elected .. the coalition would give every taxpayer a receipt showing
details of Australian government debt and how tax money is spent .. because taxpayers
rightly feel they're being ripped off.

Police are searching bushland in western Sydney .. after a woman's body was discovered
in a reserve at Doonside last night.

Detectives and local police are investigating .. while riot squad officers are scouring
bushland and police divers are searching waterways for evidence.

Police are also appealing for anyone with information about the death to come forward.



Toll Vic 200 (MELBOURNE)

Police say it will take a miracle to bring Victoria's road toll under control .. as
the 200th person this year died in an early morning collision.

The state now has 19 more deaths on its roads this year compared to last year .. after
a 19-year-old driver died when his car hit a tree lying across the road in Melbourne's
southeast.

Deputy Commissioner KEN LAY says the state could end up with as many as 350 dead this
year .. which hasn't happened since 2005.



Raids (MELBOURNE)

Victoria Police say they've smashed a major drug ring .. seizing millions of dollars
worth of heroin and two-and-a-half million dollars in cash.

They've also arrested 12 people in early morning raids on 14 properties in Melbourne's
inner and western suburbs.

Police say the heroin is believed to have a street value of several million dollars
.. and about 20 million dollars worth of real estate has also been seized.



Weather Vic (MELBOURNE)

This morning's road death is being blamed on Melbourne's wild weather .. which has
knocked trees down across roads .. causing several accidents.

The Bureau of Meteorology says wind gusts reached up to 100 kilometres an hour along
Melbourne's southeast bayside suburbs .. while there was wind damage at Ballarat and flash
flooding at Warrnambool and Port Fairy.



Weather Qld (BRISBANE)

The southern end of Queensland is bracing for another severe 24 hours of weather.

A severe weather warning is current for the state's southeast for wind gusts in excess
of 90 kilometres an hour .. while the Granite Belt can expect sleet and temperatures below
zero early tomorrow.



Heaters (SYDNEY)

The New South Wales government has released a list of 101 schools which will have unflued
gas heaters replaced by next winter .. but it's refusing to announce when it'll extend
the program to the rest of the state.

The government will spend 15-million dollars replacing heaters in schools mainly in
the Southern Highlands .. Central Highlands and Blue Mountains.

While eating chocolate is a pleasure for humans .. the ingredient theobromine .. a
stimulant found in cocoa beans and all chocolate .. is a toxic danger for pets.

RSPCA veterinarian Dr MAGDOLINE AWAD says dogs are unable to metabolise theobromine
quickly and its accumulation .. combined with the caffeine .. leads to chocolate intoxication.

If consumed by pets .. the high fat and sugar content of chocolate can lead to vomiting
.. diarrhoea .. bloating .. restlessness .. and finally hyperactivity .. excessive urination
.. cardiac arrhythmia and even death.

She says pets should not be given any chocolate.

Qld: Search resumes for lost bushwalker

The search has resumed for a 65-year-old bushwalker missing in a south east Queensland
national park since Saturday afternoon.

ROBERT YOUNG had been bushwalking with a group of friends within the Lamington National
Park in the Gold Coast hinterland when he became separated from the group around 1.30pm
(AEST) on Saturday.

Police hold serious concerns for Mr YOUNG as overnight temperatures were expected to
drop and he was last seen wearing only shorts .. a navy blue shirt and walking boots.

He was also carrying a black backpack which may have contained a jumper and some limited
supplies.

Vic: Police arrest man after woman's body found in backyard

MELBOURNE, Feb 10 AAP - Police are treating as murder the death of a woman whose body
was found buried in a backyard in Melbourne's west today.

The 53-year-old woman's body was unearthed about 4am (AEST) after it was found buried
at a home in Hogans Road, Tarneit.

A 41-year-old Tarneit man who lives in the house was arrested and is currently being
questioned by detectives at the St Kilda Road police headquarters.

The woman's body has been taken to coronial services.

About 9.30pm, last night, police visited the house after they were called to conduct
a welfare check on the woman.

They could not find her and, after receiving information from the man inside the home,
contacted the Homicide Squad.

No other people were at the house at the time.

Qld: Man stabbed at party

BRISBANE, April 8 AAP - A 22-year-old man has been charged over a stabbing at a party
in central Queensland.

Police said two men were drinking at a party at Clermont, north of Emerald, yesterday
when they began fighting outside the Racecourse Road home about 5.30pm (AEST).

Police said during the fight the 22-year-old went inside the house and got two knives.

He allegedly stabbed a 23-year-old man after he had been punched by him in the head twice.

The injured man was taken to Clermont Hospital and then airlifted to Townsville to have surgery.

The 22-year-old will face the Clermont Magistrates Court on April 23 on one count of
unlawful wounding.

Slovakia: U.S. company to invest hundreds of millions in the country

A financial group from the United States plans to invest hundreds of millions in a new plant in eastern Slovakia that would produce composite materials for automotive and maritime industries, a government statement said Thursday.

The Delaware-based Simonstein and Henriks Finance Corp. has pledged it would invest some euro438 million (US$564 million) for the two-year development of a factory in the eastern Slovak town of Spisky Hrnov, according to a statement by the government's Agency for Attracting Foreign Investments.

Gerard Leroux, a representative for the investor, was quoted as saying that production in the new plant was scheduled to start by 2008 and that the investment was prompted by the "suitable investment environment in Slovakia."

The investment would create more than 1,000 jobs and boost the development of Slovakia's east where the unemployment rate is 15 percent, the statement said.

Slovak Prime Minister Mikulas Dzurinda was also quoted as saying that the state would allocate some 5 percent of the overall investment for the development of roads and infrastructure in the Spisky Hrnov region.

No officials from the Simonstein and Henriks Finance Corp. were available Thursday for comment and an Internet search yielded no information about the company.

At a news conference later on Wednesday, Slovak Finance Minister Ivan Miklos has also refused to provide more details about the investor, the TASR news agency reported. Miklos said only that the initial information about the investor came "from the Prince of Liechtenstein" and that he considered that "a serious one."

The announcement about the investment comes less than 10 days before June 17 general elections. Dzurinda's ruling coalition is struggling to win a third consecutive term, but his Slovak Democratic and Christian Union has the support of just 11.4 percent of voters, while his key rival Robert Fico and his Social Democracy party lead the polls with 32 percent.

Lying on his family room floor with assault weapons trained on him, shouts of "pedophile!" and "pornographer!" stinging like his fresh cuts and bruises, the Buffalo, N.Y., homeowner didn't need long to figure out the reason for the early morning wake-up call from a swarm of federal agents.

That new wireless router. He'd gotten fed up trying to set a password. Someone must have used his Internet connection, he thought.

"We know who you are! You downloaded thousands of images at 11:30 last night," the man's lawyer, Barry Covert, recounted the agents saying. They referred to a screen name, "Doldrum."

"No, I didn't," he insisted. "Somebody else could have but I didn't do anything like that."

"You're a creep ... just admit it," they said.

Police say the case is a cautionary tale. Their advice: Password-protect your wireless router.

Plenty of others would agree. A Sarasota, Fla. man got a similar visit from the FBI last year after someone on a boat docked in a marina outside his building used a potato chip can as an antenna to boost his wireless signal and download an astounding 10 million images of child porn.

For two hours that March morning in Buffalo, agents tapped away at the homeowner's desktop computer, eventually taking it with them, along with iPads and iPhones.

Within three days, investigators determined the homeowner had been telling the truth: If someone was downloading child pornography through his wireless signal, it wasn't he. About a week later, agents charged a 25-year-old neighbor with distribution of child pornography.

Comcast President Steve Burke is optimistic that the third-largest cable operator will complete carriage talks with Disney in two or three weeks, he told the Washington Metro Cable Club last week. The two have been in tough negotiations over whether Comcast systems have to carry Disney's new SoapNet channel and add the Disney Channel to basic tiers.

Burke also outlined the rebuilding of the third-largest cable operator: "Nearly 95% of our company wilt be rebuilt by next year." CDT COMMENTS BEFORE THE DEPARTMENT OF COMMERCE IN THE MATTER OF CYBERSECURITY, INNOVATION, AND THE INTERNET ECONOMY.

WASHINGTON -- The following information was released by the Center for Democracy & Technology:

The green paper deals broadly with establishing a framework for the cybersecurity challenges faced by companies outside the critical infrastructure and key resources designation. In particular, the green paper identifies an "Internet and Information Innovation Sector" ("I3S") and lays out several policy recommendations intended to help this sector develop security best practices and voluntary codes of conduct as well as incentivize private sector cybersecurity efforts. We applaud the Department for taking up this issue. We believe the Department's overall approach to non-critical network security is essentially the

right one, with a focus on incentives, transparency and best practices promoted through voluntary, collaborative endeavors with private industry.

However, while it is useful to distinguish between critical and non-critical systems, and while it is appropriate to develop government policy for improving the security of non-critical information and communications systems, we want to warn at the outset of our comments that the distinction can also be misleading. The green paper recommends an approach to cybersecurity policy

for non-critical infrastructures that is based on voluntary standards, public-private cooperation, transparency, respect for privacy, and the protection of innovation. Yet those very same principles should also govern the framing of policy for critical infrastructures, and it would be a mistake to take the distinction between critical and non-critical infrastructures as suggesting otherwise.

Dark Fiber Africa Mtunzini fiber link goes live.(SERVICES)

Dark Fiber Africa has switched on a new, R350 million fiber system linking Gauteng and Mtunzini on the KwaZulu-Natal north coast, saying the new route should put renewed downward pressure on broadband prices.

The route is the first between Johannesburg and the coastal town to operate on "open-access principals." Dark Fiber Africa believes this could have a significant impact on the cost of connectivity for Internet service providers and telecommunications operators.

Webcam wonder: It's Keenan's world, for now; Close Up.(News)

ELMHURST, Ill. -- It started innocently enough, with a boy hamming it up in front of a computer webcam.

He was doing what teens often do when they stand in front of mirrors: Lip-syncing to a popular song, acting goofy, being himself, as if the world wasn't watching.

Except, in this case, the world was watching when Keenan Cahill -- then an impish 13-year-old with a knack for oddball humor -- started posting videos of himself on YouTube.

First, there were hundreds of hits, then thousands, then millions. And an Internet sensation was born.

"Keenan, what have you done?" his mom asked when a late-night talk show called and wanted to air one of his lip-syncing videos. She wasn't sure whether to be amused or horrified.

What if people made fun of her son, who has a rare genetic disease that has stunted his growth? What if he'd opened the door to something too big to handle?

For Keenan, though, this was the adventure he'd been waiting for. This was freedom for a young man whose life had, so far, mainly consisted of spending time at hospitals, when he wasn't going to school or hanging out in his room.

For him, a vacation was going to Minnesota to a Childrens hospital, where he's had several surgeries on his legs and hips.

Now he gets to travel to places like the Bahamas and France, Los Angeles and Las Vegas. Fans crowd around him as if he were a rock star, their cellphones extended to capture photos and video.

Perhaps most surprising are the celebrities and their representatives who contact him regularly. They want a piece of him, to be seen with him, shoot a video with him, to drink whatever potion there is that equates to online clicks, a new measurement of star power.

And it IS a power, at least right now.

"I finally got somewhere, out of all the people," says Keenan, who's now 16. "I used to pray to God. It's like a switchback now. I say 'Thank you' instead of, 'Can you please get me there?' "

Discovering the disease

When Keenan was born in 1995, there was little to indicate that anything was wrong. His parents had noticed that his kneecaps were large, but didn't think much about it. Then one day, at 6 months of age, his mom remembers Keenan's face looking puffy, as he sat in his high chair for a feeding.

"Honey, are you OK?" she said aloud.

By age 1, Keenan had fallen off the growth charts. He didn't walk until he was 18 months old and had unusual fits of vomiting that worried his parents.

They took him to the Mayo Clinic in Minnesota where he underwent several tests. Doctors also sent a skin graft to a lab in Australia for testing. That led them to determine that Keenan had a severe form of an extremely rare disorder called Maroteaux-Lamy Syndrome, also known as MPS, type 6.

People who have the disease are unable to break down complex sugars called mucopolysaccharides, which accumulate in connective tissue and organs throughout the body. Fewer than 1,100 of people worldwide have the disease, which leads to severe disability and a shortened life span in most cases.

Doctors told Keenan's parents that their son would likely be in a wheelchair by the end of his teenage years if he was not treated. His growth would be extremely hampered, though with this particular type of MPS, there would be no cognitive impairment.

And if he didn't have a bone-marrow transplant early on, he could have died sooner. So in 1997, at age 2, Keenan had that transplant -- the first of several procedures and surgeries he has undergone.

"It was the worst time in my life," his mom, Erin O'Brien-Cahill, recalls.

After the transplant, Keenan stayed at the hospital for four months and, for a year, couldn't play with other children or be around other people much to avoid exposing him to illness. His mom had to quit her job as a mortgage underwriter to stay in Minnesota with him. His dad, an electrician, got a job at the University of Minnesota so that he could be with them, too.

Family photos of Keenan show a little boy whose shocks of red hair fell out and eventually came back dark brown as a result of treatments related to the transplant. Over the years, he would grow to his current height of 4-foot-1.

But although he looked different from his peers, he always felt like a regular kid and thrived on making people laugh.

Some have compared Keenan to Gary Coleman, the late actor whose growth was stunted by a kidney disease. But when he's out in public, people most often stop to tell him that he looks like the young spectacle-wearing actor from the movie "Jerry Maguire."

Keenan also wears thick glasses that often drop down to the end of his nose. But it's his smile, sometimes cheesy, sometimes sincere, and his expressive face that draw people in.

The attention made Keenan think about an acting career for himself, gave him something to shoot for.

"I always wanted to be on camera," he says.

His mom, wanting to give her son something positive to focus on, took him to talent agencies in the Chicago area. He auditioned a few times, but nothing ever came of it.

Then he got a desktop computer with a webcam for his 13th birthday, and a window opened.

Star status

Some might snicker at the notion that Keenan is a star. They might not believe this can really happen to some kid who shoots low-budget videos in his bedroom.

But one only need observe the fervor with which people try to contact him to understand that this phenomenon is, indeed, real.

"It's completely redefined the definition of celebrity," says Victor Mehren, a senior marketing director at the Wrigley Co., which hired Cahill to appear in an online advertisement for Juicy Fruit gum in which he stars with a cartoonish singing unicorn.

Keenan hesitates to call himself a celebrity, partly because his manager has advised him not to focus on fame. He's not even supposed to say the words "celebrity" or "fame."

"I need to stay grounded," he says. He talks about backup plans and college. He shrugs nonchalantly when people ask if students at school give him extra attention. "Not really," he says. "Kids know about it, but they don't make a big deal."

Truth be told, though, Keenan is extremely enamored with his new life. He checks his YouTube and Twitter stats. He monitors his cellphone constantly for news about his next public appearances, which he makes on weekends and vacations so he doesn't miss school. That's his mom's rule.

He's helped open a teen club in the Bahamas. He's shot a commercial with actress Jennifer Aniston, which has gotten more than 8 million hits. He's done videos with rapper 50 Cent and "Jersey Shore" star DJ Pauly D, among others.

He's also joked comfortably with comedian Chelsea Handler on her late-night talk show, giving her his phone number and calling her a "cougar," a teasing reference to women who go after younger men.

And pop star Katy Perry sent him a video greeting, with other celebrities included, when Keenan recently turned 16.

Perry, whom Keenan has never met, is the one he calls his "mentor," the one who sent his life into an upward spiral last fall with a simple posting on Twitter, after she saw a video of him lip-syncing to her song "Teenage Dream."

"I heart you @KeenanCahill," the tweet read.

Keenan had already been getting attention, but this took it to a new level. The emails and phone calls poured in.

It was too much to handle. So when David Graham and Mark Long, who got their start in reality TV, approached Keenan and his mom about being on one of their shows, his mom asked if they would be his managers.

"When Mark and I got Keenan, we said, 'OK, we're going to set this kid up right from day one,' " says Graham, who's based in Las Vegas.

No drinking and no partying, they said, setting rules that were no problem for a kid who seems to have no interest in that, anyway.

And no appearances on B-level talk shows. "He doesn't need that, doesn't need to be overexposed," says Graham, who's focused more on videos with celebrities, ad deals and club appearances. Keenan also has recorded his own song -- one in which he actually sings -- set for release this spring or in early summer.

It sounds like it might be lucrative, but the financial rewards are not that great, Graham says.

"He's not going to be able to retire off this. This is more or less a cool after-school job," he says. "For him to really cash in, he'd have to land a TV show or a movie."

That's Keenan's big hope, that this attention will lead to a sitcom. But Graham isn't sure that will happen.

"I don't want Keenan to go to LA and experience failure. I want him to come there, shoot something and go home," Graham says. "I don't want him to have a TV show that fails and have him go back to school and everyone makes fun of him."

Bizarre lifestyle for teen

Keenan's mom, who's back working in the mortgage-insurance industry, continues to shake her head at all this, though usually with a smile on her face. Her boy is happy, and that makes her happy.

"It's insanity," she says as she sits in the suburban Chicago town house she and Keenan share with his younger sister, "but a good insanity."

Keenan's parents divorced five years ago, though his dad still accompanies him to some of his engagements.

It is, indeed, quite a heady and sometimes bizarre scene for a 16-year-old. Keenan is whisked in and out of nightclubs, where he usually can't stay too long because he's underage. He signs autographs. Poses for photos with Playboy bunnies in Las Vegas, baseball players at spring training in Arizona, people on the street who stop him.

One club in Israel hosted a "Keenan Cahill Worshipping Party" late last year. Keenan wasn't able to attend, so partygoers danced with posters of him, instead.

The party's tongue-in-cheek tone hinted that Keenan was more a curiosity, almost a pop-culture caricature of himself.

Some would call it playful fun.

But it's gone well beyond that on his YouTube page, where the comments are sometimes brazen, and harsh. People have called him everything from a "rent-a-dwarf" to a "freak," and worse, though those comments often send his fans rushing in to defend him.

Others question whether the celebrities who do videos with Keenan are really just using a naive teenager, one who has a disability, no less.

One could argue, though, that it was Keenan who originally used a lot of artists' songs, without permission, to get famous. So it raises the question: Who's using whom?

"We think that about child stars: 'Oh, he's being used. He's being abused. People are taking advantage of him.' Why that hasn't been a problem so far [with Keenan] is that he seems to be enjoying himself," says Kelly O'Keefe, a professor of brand management at Virginia Commonwealth University.

"He put himself out there. Now he's living a dream and getting to meet celebrities."

Keenan sees some of the mean comments online, but just shrugs.

"I think it comes from my mom always telling me, 'You're normal,' " Keenan says. It doesn't really bother him.

The fun he's having also has made dealing with the realities of his medical condition easier.

This summer, he'll have yet another surgery to reconstruct a hip and straighten a leg. Other procedures he's undergone include surgeries to staple the growth plate in his knees to straighten them and another to decompress his brainstem.

Each Thursday, he also gets a four-hour infusion, called enzyme replacement therapy, at home or at Children's Memorial Hospital in Chicago.

Keenan is among the first wave of patients with MPS 6 to receive these infusions, which seem to slow the progression of the disease.

"We can't reverse necessarily all of the damage to various organs," says Dr. Barbara K. Burton, a clinical geneticist who heads the MPS treatment program at Children's Memorial. "But the hope is that we stabilize the disorder and increase life expectancy."

Without treatment, she says, life expectancy for patients with MPS 6 is less than 20 years.

MCI: U S West Seeks Refuge in Federal Court from PUC Probe

Bell's Action Further Delays Coloradans' Benefits of Local Competition; Defies

Pro-Consumer Policies of State Legislature and Utility Regulators

DENVER, Nov. 17 /PRNewswire/ -- MCI today joined consumer advocates, public interest groups and other communications companies denouncing U S West's effort to use the U.S. District Court in Denver to further delay Coloradans' right to enjoy the savings, higher quality, innovative new services and freedom of choice promised by local phone competition.

In its request for a temporary restraining order, U S West questions the authority of the Colorado Public Utilities Commission (PUC) to conduct a public hearing to determine if U S West's Operations Support Systems (OSS), called Interconnect Mediated Access or IMA, are in compliance with PUC directives and federal law. That hearing, originally scheduled to begin today, is now postponed pending a decision by the court.

As required by the federal Telecommunications Act of 1996, IMA is supposed to enable new competitors to instantly share customer information, process orders and billing, and handle maintenance and repair requests via fully automated links with U S West -- vital business functions new local market entrants need in order to fairly compete and provide reliable service to their customers.

"IMA is an absolute failure," said Bill Levis, regional director for MCI Public Policy. "This hearing is critical because it will allow the PUC to finally pass judgment on IMA, compelling U S West to provide a better system that will finally permit Coloradans to freely choose their local phone carrier."

The failure of IMA has forced MCI to twice delay its plans to offer competitive local service to residential and small business customers in Colorado. Consumer advocates, public interest groups and competitors have publicly challenged IMA as inadequate. Now through its federal court action, U S West hopes to prevent the PUC from confirming IMA's failure.

U S West's motivation to bar the hearing is readily apparent, based upon testimony previously presented in the case by Gary A. Klug, a senior professional engineer employed by the PUC:

"IMA has been portrayed by USWC (U S West Communications) as a "gateway" into the USWC Legacy OSS systems. I think the term 'restrictive bottleneck' is a more appropriate descriptor for the IMA system. It chokes the entry, restricts access to needed information, adds inefficient manual processes that are time consuming and introduces the likelihood of errors and delays in the CLEC's (competitive local exchange carrier's) provisioning of residence and small business service."

This assessment led commissioners to preliminarily find that the use of IMA by competing phone local companies could result in "irreparable harm" to consumers.

Compounding the challenge for new competitors in Colorado is the fact that U S West is now nearly a full year past the Telecom Act's deadline requiring that the Bell monopolies deliver these critical systems to competitors on Jan. 1, 1997. To date, not one of the five regional Bell operating companies (U S West, SBC, Bell Atlantic, BellSouth or Ameritech) has successfully met that federal mandate.

U S West's decision to take this legal action in Colorado is stunning, because it also runs in stark contrast to the policy position of the state legislature, one of the leading pro-consumer, pro-competition bodies of its kind in the nation. Colorado lawmakers passed one of the earliest local phone competition endorsing statutes in the U.S. in 1995, a full year before Congress approved the Telecommunications Act of 1996.

MCI believes this action by U S West is due to Colorado's position as the bellwether state on the OSS issue in the Bell company's operating territory. The Colorado PUC's decision could have region-wide affect because U S West offers the same system in all of its 14 states.

"U S West can run, but it can't hide," said Levis. "After unsuccessfully appealing this issue to both the FCC and the PUC, U S West is running to the federal court as a desperate last resort to deny consumer choice and maintain
