Gambling debate hampers NC tribe's recognition bid

The Lumbee Indians of North Carolina, tired of being not quite a tribe in the eyes of the federal government, are watching their best-ever chance at recognition slip away because of a dispute over the role gambling should play in their future.

Failure would mean the largest Native American tribe east of the Mississippi would continue missing out on millions in funding for housing, education and health care.

"We've got the ball and we're running toward the end zone, and suddenly we're being stopped," said Beth Jacobs, a Lumbee who has emerged as a leader among members who say recent decisions by tribal leaders are jeopardizing the recognition bid.

Man charged with murder after fire planes collide

HOPLAND, Calif.--A man was charged with murder Tuesday in thedeaths of two pilots whose firefighting planes collided over a blazethat may have broken out at an illegal drug lab in the woods.

Frank Brady, 50, of Redwood Valley was being held without bailafter Mendocino County prosecutor Norm Vroman filed the charges.

A second man, Richard Mortensen, 43, of San Pablo was arrested onoutstanding warrants for drug and weapons charges. Vroman said he mayalso be charged in the deaths.

Iran Invites IAEA Team to Tehran

VIENNA, Austria - Iran has invited an International Atomic Energy Agency team to Tehran to draw up a concrete plan for clearing up suspicions about its nuclear program, an IAEA spokeswoman said Monday.

Melissa Fleming said the invitation was issued by Ali Larijani, Tehran's chief nuclear negotiator, on Sunday during talks with IAEA head Mohamed ElBaradei.

Court: US museum can keep work sold in Nazi era

BOSTON (AP) — A federal appeals court has ruled that Boston's Museum of Fine Arts can retain ownership of a 1913 painting by Austrian artist Oskar Kokoschka that was sold during the Nazi occupation of Austria.

The 1st U.S. Circuit Court of Appeals ruled Thursday in a lawsuit the museum filed against Claudia Seger-Thomschitz, who claims Kokoschka's "Two Nudes (Lovers)" was sold under duress in 1939 by one of her ancestors, Oskar Reichel, a Jewish doctor and art collector who lived in Vienna.

The museum said its research showed the painting was sold voluntarily and was eventually donated to the museum in 1973.

As fans of Japanese role-playing games from the likes of Square-Enix (and now, Ubi Soft) have probably realized, men in these gamestend to dress as flamboyantly as women. So androgenous are thecharacters, that it is, in fact, sometimes hard to tell the sex of agiven character. There are cultural reasons for this in Japan, butit sometimes makes it difficult for American gamers to follow alongwhen those games are imported Stateside.

"Enchanted Arms" is no different. Set in a school of magic, themain action centers around a student named Atsuma who may or may nothold the power to save or destroy mankind. His classmate Toya iskind of like a typical high school jock who is everybody's friend.The third in the triangle is Makoto, who, despite the fabulousclothes and manicured nails, happens to be a pretty good fighter,too. Makoto is in love with Toya and is jealous of anyone oranything that comes between them.

Of course, what sets this apart from the usual RPG is that Makotoisn't a she, but rather a he. Makoto may very well be the firsttranssexual in a video game (readers: correct me if I'm wrong).

Outside of "The Crying Game" elements, there are few surprises.It's a solid RPG with all the whistles and bells of the genre, butnothing more. Still, I can't fault it for succeeding at what it wastrying to do.

The game borrows a bit from Jewish folklore in that humanity isat war with artificially created creatures called "golem." And muchlike the Jewish golems, most of them are brainless and bent onnothing but destruction.

The turn-based attacks that make up much of the gameplay requiresome strategy. Each of the characters and enemies have one of sixattributes: earth, wind, water, fire or light and dark. Water doesdouble damage against fire, wind against earth, etc. So, you want tohave your fire-based character attack enemies with water attributes.Players also have the ability to create their own golems frommaterial and gems they collect and have them join their army.

This solid but predictable RPG will keep you busy for at least 40hours.

Sometimes, it is possible to find new life in old formulas.Majesco has published Sandbox Games' "Cake Mania." It is essentially"Rootbeer Tapper" set in a bakery. But the new game is hardly just apale comparison to the arcade classic. Think of it more as a funhomage.

You play as Jill. Upon returning from culinary school, you findthat your grandparents' beloved bakery has been forced out ofbusiness by the price-cutting jerks at the Meglomart. You'redetermined not to go down without a fight, so you reopen the bakeryin your house. Customers come in, show you the shape of the cake andthe color of frosting they want, you select the right cake to cookat the oven, the right frosting at your frosting table, give themthe complete cake and take your money (and tip, if you're quick).

Some customers are more demanding (two-layer cakes, each with adifferent color of frosting) and some are impatient. The latter canbe bribed with cupcakes (provided you've purchased the microwaveupgrade between rounds). It's a fun, challenging and slightlyaddictive game. Alternate version available for the PC. Now ifyou'll excuse me, I've got to get back in the kitchen. (Rated E)

COOKING MAMA COOKOFF

There's something off, all right. The original "Cooking Mama"game for the DS was a delight. You cleaned vegetables, chopped meat,fried and boiled things all with the DS stylus.

Shouldn't things improve when a game makes its way to a home-video game console? Majesco has the recipe all wrong. The motion-sensor controls don't work as you would expect them to. Peeling apotato is even harder with Wii-mote than it was with the stylus. Inone recipe, you have to crack an egg or two by moving the Wii-mote.It's too sensitive, however, and you usually end up repeatedlysmashing your eggs. It all ends up a half-baked, frustrating mess.Mama's stereotypical Japanese accent ("Just rike mama") might alsobe offensive to some (Rated E for alcohol references).

Sony halts 20-gig PS3

It's out of here. Sony has discontinued the 20-gigabytePlayStation 3 game console so it can focus on a more popular -- andexpensive -- model that has a bigger hard drive.

Since the launch of the PlayStation 3 in November, consumers havebeen buying the 60-gigabyte model 10 to 1 over the cheaper unit,said Dave Karraker, spokesman for Sony Computer EntertainmentAmerica Inc.

Both models have much of the same hardware inside, but the 60-gigabyte console, which costs $600, has built-in wireless supportand slots for memory sticks and other storage media.

Retailers still have several thousand 20-gigabyte models on storeshelves, Karraker said last week. The 20-gigabyte consoles willcontinue to have a suggested retail price of $500 until supplies runout.

"Better to put resources toward the ones that retailers want,"Karraker said.

Severe production shortfalls in the months after the PlayStation3 debuted meant that thousands of consumers had to wait in longlines and still couldn't buy a console.

South Korean trade chief optimistic on US talks

SEOUL, South Korea (AP) — South Korea's trade minister expressed optimism that talks Tuesday with his U.S. counterpart could make progress on a stalled free trade deal ahead of a meeting next month of the two country's leaders.

Key security allies for decades, Seoul and Washington negotiated a landmark deal to slash tariffs and other barriers to trade in April 2007 and signed it three months later.

Changes in government in both capitals, the global economic slump and demands by the United States that South Korea make concessions on trade in autos and beef have left the agreement unratified by legislators.

Seeking a breakthrough, President Barack Obama and his South Korean counterpart Lee Myung-bak vowed in June to try and resolve differences by the time they meet at the Group of 20 summit in Seoul, which takes place Nov. 11-12.

South Korean Trade Minister Kim Jong-hoon, who led South Korean negotiators over the 10 months of arduous talks it took to clinch the initial deal, was scheduled to meet U.S Trade Representative Ron Kirk in San Francisco on Tuesday.

"I think it will go well," Kim told reporters as he left for the airport to fly to the United States.

Kim said it would be his first meeting with Kirk since Obama and Lee met in June. He added that the San Francisco talks would be a half-day meeting and others could follow. The veteran trade diplomat also said that "everything is to be discussed," though provided no specifics.

The U.S. says that the deal cannot go forward without addressing South Korea's overwhelming surplus in auto trade and a further loosening of restrictions on imports of American beef. Seoul has resisted any formal renegotiation of the deal, but has said it is willing to discuss U.S. concerns.

Kim spoke after giving a speech to European business executives in Seoul, where he trumpeted the benefits of a major free trade deal that South Korea and the European Union signed earlier this month in Brussels. The agreement is expected to come into force July 1, 2011, pending approval by the South Korean and European parliaments.

"The European Union will have secured a solid beachhead in (the) Korean market that is relatively small but vibrant and from where you can expand into the larger market in Asia," Kim told the executives.

Despite starting their negotiations a month after those between the U.S. and South Korea concluded, Seoul and Brussels have made up for lost ground and could see their deal take effect sooner.

The 27-member European Union is South Korea's second-largest trading partner after China. The EU is the largest foreign investor in the Northeast Asian country.

Obama said in June that he wanted the deal with Seoul wrapped up so he can submit it to Congress for approval within a "few months" after his visit to Seoul in November. South Korea's National Assembly must also ratify it.

Bilateral trade between South Korea and the U.S. totaled $66.7 billion in 2009, down sharply from $84.7 billion in 2008 as global commerce suffered during the economic downturn. The U.S. ranked as South Korea's fourth-largest trading partner behind China, the EU and Japan.

The top U.S. diplomat for East Asia said Monday in Washington that the talks on the deal must succeed.

"We cannot afford to fail," U.S. Assistant Secretary of State for East Asian and Pacific Affairs Kurt Campbell said in a speech. "It is absolutely essential that we are successful with a Korea free trade agreement."

Israeli army to investigate Palestinian's death

An Israeli rights group says the military is belatedly opening an investigation into the death of a Palestinian man killed by a tear gas canister during a West Bank protest.

The canister fired by an Israeli soldier knocked down Bassem Abu Rahmeh in April 2009, during a demonstration near the village of Bilin.

The military first said Abu Rahmeh was in a group of Palestinians hurling rocks at troops. But video footage showed him shouting, not throwing rocks, when he was shot.

Sarit Michaeli of B'tselem says the military informed the group on Monday of the decision. The military had no immediate comment.

Michaeli said there was "no justification" for the army taking 15 months to investigate the death, which she said was recorded on three video cameras.

European stocks close higher

European stocks rose Tuesday for the first time in four sessions, as investors viewed the recent selldown related to subprime as overdone.

U.K.'s ICAP paced an advance by financial services stocks after reporting first-half earnings that exceeded expectations. Oil stocks such as StatoilHydro, Total and Royal Dutch Shell rose alongside the price of crude oil.

"Valuations offer significant support," said ABN Amro strategist Ian Richards. "Equity valuations look low when considered either from a long-term perspective, or compared to the norms of the post-2003 era."

The Dow Jones Stoxx 600 Index closed 1.1 percent higher at 358.65. The U.K.'s FTSE 100 Index gained 1.7 percent to 6226.5, while France's CAC-40 Index rose 1.4 percent to 5506.68. Germany's DAX Index closed 1.6 percent higher at 7630.31.

European markets recouped some losses after the renewed credit crunch concerns had sent markets into a downward spiral over the last three sessions.

"At the moment, it's a pretty tricky market, it's hard to know at this point how the year is going to end," said Artemis CEO Mark Tyndall at a conference in London.

The high level of market activity since September has proven beneficial for the world's largest interdealer broker by revenue. The U.K.'s ICAP reported a 34 percent rise in first-half pretax profit from active trading markets and growth in electronic broking. The shares shot up 13 percent.

Oil stocks rebounded alongside rising crude oil prices that topped US$96 a barrel. Statoil Hydro shares closed up 3.7 percent.

Total rose 1.7. Royal Dutch Shell shares climbed 2.8 percent.

However, it wasn't all positive news for stocks Tuesday. Sweden's Ericsson plummeted 11 percent as the company warned that fourth-quarter sales were likely to be in the lower end of its forecast range.

The U.K.'s Northern Rock lost another 9.9 percent after the Times newspaper reported late Monday, without citing sources, that U.S. private equity firm, Cerberus Capital Management has dropped plans to table a bid for the beleaguered bank.

Vodafone, the world's largest mobile phone operator by revenue, said that it has no plans to issue further injunctions against rivals exclusively selling Apple's iPhone, after earlier doing so against Deutsche Telekom's T-Mobile in Germany. Vodafone edged up 1.5 percent to 193 pence.

Good soil is extremely important for the success of a garden. Ifyou are undertaking any major construction, work with yourcontractor to ensure that your site is restored with adequatetopsoil. Planting beds for trees and shrubs should have 12 to 18inches of topsoil. Remove any small amounts of clay left on top ofthe soil.

Regrade garden beds after construction. It is best to use roughblack topsoil to regrade your planting beds. Pulverized soil may beeasier to work with, but it has had its structure ruined in thepulverizing process. If you have access only to pulverized soil,amend it with compost to begin rebuilding the soil structure.

Before adding compost or tilling garden beds, grade your bedroughly as needed. Hand-spading the bed to loosen the soil makestilling easier and allows you to incorporate compost more deeplyinto the soil. The goal is to uniformly work the compost into thesoil throughout the entire bed.

Problems with crabgrass? If you had problems with crabgrass inyour lawn last year, now is the right time to apply a pre-emergentherbicide to prevent weed seeds from germinating. Before applyingthe herbicide, complete all spring lawn maintenance tasks such asraking and core-aerating. This will help maintain the barrier thatthe chemical herbicide forms against weeds. Since pre-emergentherbicides will also prevent grass seed from germinating, do notapply grass seed at this time. Late August to early September is agood alternative time to install fresh grass seed.

Daffodils are easy to grow and wildlife-resistant! They shouldget plenty of sunlight for six weeks after they bloom so the leavescan make food for next year's flower show. Dividing them is notnecessary normally, but if need be, wait until they finishflowering. Dig under the whole clump with a spading fork, shake offthe loose soil, and carefully separate the roots of the large bulbsfrom each another. Replant at the same depth in a new sunnylocation. Removing spent flowers is good for aesthetic reasons, butmost hybrid daffodils produce few real seeds that would drain energyfrom the next year's bloom.

Using Macros and Spreadsheets in a Regulated Environment

Records produced by macros and spreadsheet calculations must comply with 21 CFR Part 11. As spreadsheet programs are not designed for regulated environments, special steps must be taken to maintain compliance.

Spreadsheet calculations are popular in all kinds of businesses. A macro is a set of commands that can be embedded in a document to add functionality to standard programs and to automated processes. Macros and spreadsheets (M&S) are also frequently used in regulated environments; for example, batch release in pharmaceutical manufacturing may be based on M&S calculations. Spreadsheet programs are not designed for regulated environments, and without preventive actions the risk that they will generate errors is relatively high. Raymond R. Panko from the University of Hawaii studied spreadsheet errors extensively. Over several surveys, he found that error rates can increase by as much as 3O0X).1

Records generated by M&S calculations are electronic records and therefore must comply with PDA's 21 CFR Part II.2 Requirements of the rule and its implementation in laboratories have been discussed in depth elsewhere.3

The primary requirements of 21 CFR Part 11 are:

* use of validated software and computer systems

* user-independent, computer-generated, time-stamped audit trails

* system and data security, data integrity, and confidentiality through limited authorized system access

* binding electronic or handwritten signatures to electronic records

* secure retention of accurate and complete electronic records.

Compared to previous interpretations, PDA's final guidance on 21 CFR Part 11 narrowed its scope to records that are required by predicate rules and can have a high impact on product quality and patient safety.4'5 Records generated by M&S calculations fall into this category, for exampie, if they are used for batch release in pharmaceutical manufacturing.

Commercial spreadsheet programs such as Microsoft Excel do not have all of the necessary functionality for Part 11 compliance. For example, Excel does not generate a Part 11compliant electronic audit trail. There are three possible ways to address this compliance problem.

Dedicated software. Perform the tasks using software that better enables users to comply with regulations. Many laboratory data systems offer dedicated custom calculators as an integral part of their data analysis functionality. Some custom calculators even have spreadsheet functionality compatible with Excel. This approach is used in some networked chromatography data systems, and it allows implementation of methodspecific custom calculations. Applications range from simple calculations, such as relative impurity calculations and so-called "responsefactor" statistics (for the evaluation of calibration precision), to more complex calculations. There are also advanced packages that allow calculations with custom values and perform dynamic limit checks based on user-defined acceptance criteria (Figure 1). This approach eliminates the necessity of manually transcribing numeric values between different computer applications and the risk of introducing precision errors while transcribing rounded numbers formatted for a specific report. Integrated custom calculators benefit from revision control, data integrity, access security, and audit trail functionality provided by commercial offthe-shelf (COTS) laboratory data packages. This reduces the scope of validation and qualification tasks for custom calculations to dedicated test cases for the laboratory data package.

Add-on software. Evaluate "add-on" software packages that better enable users of spreadsheet programs to comply with regulations.

Existing procedure improvement. Change the way spreadsheets are developed and used. Apply all available built-in functions of the spreadsheet program to increase compliance.

This article will focus on improving existing procedures to increase Part 11 compliance. Although it is important, we will not discuss M&S validation. We recommend using commonly described validation practices described elsewhere.6,7

CURRENT COMPLIANCE PROBLEMS

Before making recommendations, we will explain the problems associated with using macros and spreadsheets in a regulated environment.

Access Security. Almost everybody can access the programs. Spreadsheet software is installed on most personal computers and servers. Often, it is accessible to all users.

Personnel Qualification. Anybody can develop spreadsheet calculations and perform other spreadsheet tasks. Although spreadsheet calculations are considered software, developing these calculations does not require software development skills. Formulas can be added to spreadsheets using simple menu functions.

Change Control. Formulas and other functions of spreadsheets are easy to change and almost anyone can do so. Often, such changes are not documented, and no testing is done afterwards.

Validation. There is little awareness that spreadsheet calculations should be validated. This is especially true for "ad hoc" calculations where a user defines a formula and performs a calculation for a specific, one-time task.

Documented Evidence. Frequently, users of spreadsheet calculations are also the developers. Sometimes the developer is the only user. It may not be obvious why a process that only the developer will use needs documentation.

Change Control: Environments. Spreadsheets are developed on a specific computer configuration with a specific operating system and version of the spreadsheet program. However, they are distributed and used on computers with different configurations, operating systems, and spreadsheet versions.

Change Control: Files. Different versions of spreadsheets may be located in different areas of a computer system: a local PC, a server, or in different folders within these locations.

Regulatory Compliance. Typically, spreadsheet programs do not comply with all relevant regulations. In particular, 21 CFR Part 11 provides the most difficult compliance challenge.

Quality Management. The quality assurance department may not know that spreadsheets and macros are used for GxP work.

QUALITY AND COMPLIANCE

Bringing spreadsheet programs and macros into compliance requires three major steps:

* providing the infrastructure and atmosphere and developing policies and procedures for development, use, and documentation of such programs

* validating spreadsheet calculations and macros following documented procedures

* using security and other functions built into the programs such as Excel.

Attitudes towards spreadsheets and macros should be changed to emphasize quality and compliance. This requires a company policy, a master plan, system inventories, and procedures for development and use of M&S calculations.

Company Policy. A company should have a policy for development and use of macros and spreadsheets. This can be either part of a company's compliance or quality policy, or it can be a stand-alone document. The policy should be supported by management and communicated to all employees. It should include statements such as:

* Development and use of all macros and spreadsheets used in a GxP environment should follow standard operating procedures.

* All systems using M&S calculations should be registered in a database.

* All macros and spreadsheets should be validated following standard procedures.

* Changes should follow established change control procedures.

* Security and other spreadsheet program functions relevant to compliance should be applied.

* Macros and spreadsheet programs should be protected against accidental and incidental changes.

Compliance Master Plan. While the company policy dictates what needs to be done, a master plan guides implementation of the policy. The master plan should include examples that help elucidate the policy. The compliance master plan should include:

* a list of which spreadsheets must follow the policy

* templates for system inventory

* assignment of responsibilities

* a list of SOPs for implementation

* a list of generic requirements for macros and spreadsheets (for an example, see "Recommendations," p. 42).

System Inventory. All M&S calculations should be registered in a database. Entries should include information on the spreadsheet program, the operating system, computer hardware, the application, and a list of authorized users (see "Inventory Control Example"). It is very important to update the information with any changes, for example if additional users are added.

Standardize Hardware and Software. Standardizing operating systems and spreadsheet programs (including their version) helps reduce:

* required user information for installation and use

* validation effort

* support during installation and use

* errors due to incompatibility of versions.

For example, all users should switch from one version of an operating system and spreadsheet program to the next one within a given time frame. PC hardware is less critical, but many organizations also standardize on selected vendors and models for cost and support reasons.

Standardize Software Development. Development of macros and spreadsheets should be standardized as much as possible. The following are some of the items that should be standardized:

* design conventions, such as dropdown lists

* name conventions, such as rt_data_entry, std_results

* code conventions

* code annotations, such as comments in the header

* formulas for specific tasks

* colors for cells, such as using the same colors for entry fields (yellow) and alerts (green)

* spreadsheet annotations (such as file name, version)

* validation and testing.

Routine Use. Most errors made in M&S applications are not due to poor programming or insufficient testing but arise from improper use during routine work. There are multiple reasons this may occur.

* New users are working with the spreadsheets without training.

* Unauthorized users are working with the spreadsheets.

* Users input changes to the worksheet, and save the file under the same name.

* Users enter erroneous data.

Fortunately, these problems can be overcome or minimized. Because spreadsheet programs are so common and easy to use, users may think they don't need any training. While this may be true for the program, it is not always true for specific workbooks. Prior to using such workbooks, users should at least read instructions on what can go wrong when working with the worksheet.

Spreadsheets should be located on a server that limits access to authorized users. Whenever possible, store and retrieve macros on a secure server.

Procedures should be in place so that only original M&S can be used. This can be achieved through a combination of the following procedures:

* Allowing read-only access prevents the spreadsheet from being modified and saved under the same name in the same directory.

* Protecting cells that contain formulas is necessary to ensure accurate results.

* Displaying the file name and the directory on all spreadsheets (including printed outputs) alerts users if they are working in a spreadsheet that has been saved under the same name in a different directory or under a different name.

Minimizing or preventing incorrect data entry can be achieved through program design by using drop-down lists and implementing entry checks for data type and ranges.

Documentation. Correct and complete documentation is important for inspections. It also allows people who have not been involved in development and testing of the M&S to understand and review the procedures. The following documents should be available:

* company policy or quality plan for macros and spreadsheets

* company validation master plan with information on macros and spread-sheets

* SOPs for using macros and spreadsheets in a regulated environment, for validation of macros and spreadsheets, and for change control

* system inventory listing authorized users, locations of computer hardware, system software, spreadsheet program and version, spreadsheet file names and versions

* validation project plan

* requirement specifications

* design specifications

* design review reports

* code with annotations

* code review reports

* test plans and protocols

* installation reports

* change control reports

* history logs

* validation reports

* Part 11 assessment, gap analysis, risk assessment and active correction plan.

IMPLEMENTATION SUMMARY

Although it is impossible to avoid all M&S errors, they can be minimized by following these recommendations. Although some spreadsheet programs don't have all the functions required for 21 CFR Part 11 compliance, a fully functioning quality system, a gap analysis, and an active correction plan can be of tremendous help in preparing for FDA inspections.

Recommendations for Macro and Spreadsheet Development

* Use colored cells for data entries.

* Check plausibility for data entry.

* Check results for plausibility.

* Check results for predefined limits. Change color of cells if result is not within the predefined limits.

* Add explanatory comments to key cells.

* Use meaningful cell names. For example, use "RF_Std1"insteadof"Sheet3!$D$78".

* Use meaningful table headers.

* Check formulas for errors.

* Design formulas for efficiency.

* Do not allow users to change crucial spreadsheet attributes, including seemingly minor items such as cell comments. Protect cells that contain formulas. If you use separate worksheets for entering data and for performing calculations, protect the calculation worksheets because they represent the "source code."

* Display and print the file name and location.

* Design for expandability (most spreadsheets will be expanded over time).

* Design for ease of use. For example, use separate worksheets for data entry and for internal calculations.

* Design the user interface for consistency. If two fields have the same meaning, they should have the same properties and exhibit the same behavior.

* Document spreadsheet formulas and macro commands.

* Define rules for numeric precision and rounding, especially when checking against a specification.

* Define error handling and error reporting (for example, if a result cannot be calculated due to an empty source cell).

* Define a convention for tracking and documenting every spreadsheet revision.

US investigators head to India to probe attacks

The United States is sending investigators to India to help unravel who was behind the terrorist attacks that targeted largely foreigners in the commercial and tourist center of Mumbai. Three Americans are confirmed among those injured.

The State Department urged Americans not to travel to the stricken city _ at least through the weekend _ as U.S. officials checked with Indian authorities and hospitals to learn more about the extent of casualties.

A U.S. investigative team headed to Mumbai on Friday, a State Department official said, speaking on condition of anonymity because the U.S. and Indian governments were working out final details of the cooperative effort. The official declined to identify which agency or agencies the team members came from.

Department spokesman Robert McInturff said he could not identify those injured, but The Associated Press learned the name of one victim: Andi Varagona of Nashville, Tenn. She called her mother from a hospital Thursday and said she had been shot in the arm and leg while eating dinner at the Taj Mahal Palace and Tower hotel.

She said another Tennessee woman traveling with her was also injured, according to the mother, Celeste Varagona, but the woman's identity was not immediately available.

Alan Scherr, 58, and his daughter, Naomi, 13, who as members of the Faber, Va.-based Synchronicity Foundation traveled to India to participate in a spiritual program, were missing late Thursday, said group spokeswoman Bobbie Garvey. "Our Indian contacts there have gone to all the hospitals, but they haven't located Alan or Naomi yet," Garvey said. "We're very hopeful they'll be found safe."

The group said in a statement that four members of the 25-person group _ two Americans and two Canadians _ who were staying at the Oberoi Hotel were wounded by gunfire, and were believed in stable condition.

McInturff, the State Department spokesman, said U.S. officials have activated a phone tree to contact American citizens who registered with the U.S. consulate in Mumbai. So far there is no information that any American has been killed in the attacks, said McInturff.

Authorities in India said Thursday at least 100 people were killed and at least 300 injured when suspected Islamic militants attacked 10 sites in Mumbai. Teams of gunmen stormed luxury hotels, a popular tourist attraction, hospitals and a crowded train station.

"It would be premature in view of the unfolding tragedy in Mumbai and the corresponding investigation to reach any hard-and-fast conclusions on who may be responsible for the attacks, but some of what we're seeing is reminiscent of past terrorist operations undertaken by groups such as Lashkar-e-Taiba and Jaish-e-Mohammed," a U.S. counterterrorism official said on condition of anonymity. The two groups mentioned by the official are Pakistani militants linked to al-Qaida who have fought Indian troops in Kashmir.

President-elect Barack Obama spoke by telephone with Secretary of State Condoleezza Rice for an update Thursday and received several intelligence briefings.

President Bush expressed condolences to Indian Prime Minister Manmohan Singh in a phone call from the Camp David, Md., presidential retreat.

"The president offered support and assistance to the government of India as it works to restore order, provide safety to its people and comfort to the victims and their families and investigate these despicable acts," press secretary Dana Perino said in a statement.

The State Department set up a call center for Americans concerned about family members who may be in Mumbai. The number is 1-888-407-4747.

Cadle texted what he thought was a friend, asking if the personwanted to buy some marijuana.

"Yes" came the reply from a surprised state trooper.

The two arranged a meeting, and the trooper arrested Cadle, whopleaded guilty on Monday to possession and delivery of marijuana.Instead of prison, Kanawha Circuit Judge Charles King said Cadlewill be sentenced to probation.

Norway wins mixed relay in biathlon worlds opener

KHANTY-MANSIYSK, Russia (AP) — Tarjei Boe overtook Michael Greis on the final leg Thursday to give Norway the gold medal ahead of Germany in the mixed relay on the opening day of the biathlon World Championships.

Boe was 24 seconds behind Greis when he took over from Ole Einar Bjoerndalen on the final exchange but pulled away after the prone shooting.

The Norwegian team that also included Tora Berger and Ann Kristin Aafedt Flatland finished the race in 1 hour, 14 minutes, 22.5 seconds. Germany, which also included Andrea Henkel, Magdalena Neuner and Arnd Peiffer was 22.9 seconds behind.

France rallied past Sweden on the last leg to take third, 1:16.2 behind the winner.

Berger put Norway in the lead after the first leg but Neuner shot clean and skied fast to give Peiffer a 24-second advantage over Norway after the women's part of the race.

"Tora ran a perfect leg. She managed give us the advantage over Germany and it was important for us," Bjoerndalen said. "Then Flatland didn't allow Neuner to run far away. I skied well in my leg but made mistakes at shooting ranges. Boe then was fantastic."

Greis, a three-time Olympic champion, missed two targets on the prone shooting and Boe shot clean to leave the range 3 seconds ahead of the German. Both missed a target from the standing position but Boe was the faster skier and gradually pulled away.

On the final leg, Martin Fourcade shot clean to overtake Carl Johan Bergman of Sweden and secure France its third consecutive podium in the mixed relay events this season. The world championships races also count toward the World Cup standings.

Russia's Svetlana Sleptsova left the host team without a chance after she missed six targets and ran two penalty loops to be 21st at the first exchange. Her teammates then advanced to finish sixth but more then three minutes behind the winner.

The championships continue Saturday with sprint races.

Little treasures join search for gold

Pirates invaded the Sidcot Shipmates Holiday Club over the halfterm.

Children embarked on an imaginary trip to Treasure Island to findgold at the club run by Sidcot School.

Mornings were spent on arts and crafts and afternoons on sportsand games.

The next club will be during the summer holidays from Monday,July 26, to Friday, August 20.

HIV vaccine

Researchers at the University of Maryland Biotechnology Institute (UMBI, www.umbi.umd.edu) have designed new vaccines that prevent HIV infections. The National Institutes of Health (NIH) awarded the team a $5.3 million grant to develop the best of their HIV vaccines, which will block the infection whether transmitted by sexual contact or blood exchange because it provides whole-body immunity.

Carried by a multiply mutated strain of the Salmonella bacteria with deactivated DNA fragments from HIV's outer coat, the vaccine will be swallowed in a liquid suspension. This "bactofection" technology, which involves placing a vaccine into Salmonella or another infectious bacteria species, has been previously approved by FDA.

Principal investigator George Lewis says the vaccine is extremely transportable, may not require refrigeration, eliminates the need for sterile needles, and is less expensive than other AIDS vaccines under development. "If this proves to be both safe and very immunogenic in humans, it will be a total breakthrough in HIV vaccines," says David M. Hone, associate professor at UMBI, "because of the way it attacks the virus at its first contact." Nosy neighborhood teams help keep Chinese in line

BEIJING Families go to them if they have trouble with a teenageror mother-in-law. Couples contact them for advice on birth control.Residents call them to have potholes filled outside their homes.

But China's neighborhood committees also are nosy, paternalisticbodies that have become a vital cog in the labyrinthian governmentapparatus that both bosses the Chinese from cradle to grave and caresfor them like children.

Committee members, most of them retired women, intervene inpersonal life to an extent that is astonishing to Westerners butroutine to Chinese who have lived with them since 1952, three yearsafter the communists rose to power.

Each committee is in charge of about 800 households. They areofficially considered autonomous organizations that work incooperation with the government and are elected by the people. Butordinary Chinese claim their members actually are selected bysubdistricts of city governments and the committees are essentiallyan arm of the state.

Members of the neighborhood committee on Bei Binmasi Lane inBeijing are paid 45 yuan ($12) a month to work about six hours a day,six days a week. They say they are knowledgeable about theirneighbors because many of them have lived in the area all theirlives.

Their duties range from public order and sanitation tocounseling and encouraging family planning.

Committee members patrol the streets, keep an eye open forcriminal activity and act as a deterrent against crime, said YanShouming, head of the neighborhood committee section of the city subdistrictof which the Bei Binmasi neighborhood committee is a part.

If a family has a misbehaving teenager, it can ask theneighborhood committee to help "educate" him, officials said.

If a couple or in-laws have an unresolved quarrel, a fairlycommon occurrence in China's crowded cities where many couples livewith the husband's parents, neighborhood committees can be asked tomediate.

The committees also get involved in marital disputes and thepressure is often so strong that the couple reconciles theirdifferences, even when they are serious and long-term.

Asked if the committee informs on those involved in unorthodoxpolitical thinking or actions, Yan dismissed the notion, saying thecommittee's purpose is to provide services. Traditionally, however,neighborhood committees have worked closely with the Public SecurityBureau, a police unit.

Neighborhood committees also play a role in the campaign aimedat getting people to support China's population control policy oflimiting most couples to one child, said committee member ZhaoFuying.

"When the policy started, some people wanted to have a secondchild, but now they don't," said Gao Yukun, spokesman for thesubdistrict. Since the policy went into force in the early 1980s,such severe financial and political sanctions have been imposedagainst city dwellers who want a second child that many young couplessay it is useless even to try.

The policy is less entrenched in the countryside and there havebeen reports of involvement by the rural counterparts of neighborhoodcommittees, the village committees, in attempts to make unwillingwomen have abortions.

Before some holidays, the committees conduct surprise sanitationinspections of homes, putting "Sanitary Household" stickers on thedoors of homes that pass inspection and lecturing those with untidydwellings on the bad effect of sloppiness on their health, said Gao.

Among other committee duties are safety inspections, shoppingand other chores for the elderly, and informing the city of people'scomplaints such as problems with streets, said subdistrict head Yan.

Can Clinton Overcome Obamania?

A year ago, Hillary Rodham Clinton, D-Inevitable, was joshing about whether she could appoint her husband secretary of state when she became president, and Barack Obama was urging a throng to be realistic about his own chances. "Let's face it," he said. "The novelty's going to wear off."

But a funny thing happened on the way to the Clinton coronation.

The Democratic presidential race took so many twists that close observers might have needed a chiropractor to follow it. And now Clinton, once the instant favorite in a crowded field of candidates, is struggling to overcome a daunting wave of Obamania.

"There's a problem with inevitability," said Dick Harpootlian, a former South Carolina party chairman who supports Obama. "It rarely proves to be true."

When Clinton joined the race in January 2007 with a cozy Webcast from her living room couch, the notion of a former first lady-turned-senator running to be the first female president was so new, so different, she quickly eclipsed rival candidates such as Joe Biden, Chris Dodd, Bill Richardson, all seasoned politicians with solid credentials.

"I'm in to win," Clinton proclaimed. And she had the money to back up her bravado.

"I don't think anyone can stop her," John Catsimatidis, a New York businessman and member of Clinton's finance team, trumpeted in February 2007. "She's unstoppable; she's got such a machine."

Clinton, intent on keeping 2000 nominee Al Gore out of the race, seemed to regard all other rivals as "Lilliputians," says Democratic pollster Peter Hart

Her Democratic opponents didn't buy it, though, and neither did the public.

"I lived through the inevitability of Howard Dean," scoffed John Edwards, recalling the early darling of the 2004 presidential race who quickly faded from the Democratic field.

But it was Obama, not Edwards, who emerged as the anti-Clinton.

Bidding to become the nation's first black president, Obama offered a fresh new face, and a message of hope and change that captured the public's imagination.

His first visit to New Hampshire, back in December 2006, before he'd entered the race, sparked such a frenzy of interest that even Obama dismissed it as hype, as his 15 minutes of fame.

"I think to some degree I've become a shorthand or a symbol or a stand-in for now," he said. "It's a spirit that says we are looking for different. We want something new."

Obama joined the race in January 2007, a week before Clinton, and soon proved that his appeal with voters was no passing fancy, that he was more than a cardboard stand-in.

He turned his short resume _ just two years of national experience as a senator _ into an asset by stressing that it was time for a new generation to step forward.

Obama's surprising ability to raise money _ by the boatload _ instantly served notice to Clinton that he was not to be discounted.

He matched Clinton almost dollar for dollar in the first three months of 2007, and breezed right past her in the next quarter _ raising $33 million to her $27 million. By year's end, both had raised more than $100 million and blown through at least $80 million, muscular figures that no other Democrat could touch.

"That really changed the whole tenor of the race to becoming more of a two-person contest than a coronation," said Anthony Corrado, a campaign finance expert at Colby College in Maine.

Clinton did her best to maintain the illusion of inevitability nonetheless.

In July, she dismissed Obama as "irresponsible and frankly naive" on foreign policy.

In September, she ran the gantlet of five Sunday talk shows in one day, working in the phrase "When I'm president" at least seven times.

As recently as November, she calmly told an interviewer that despite Obama's surprisingly strong challenge, "it will be me."

Late into the fall, there were plenty of believers in a Clinton juggernaut.

"If this were a wedding, we'd be at the 'speak now or forever hold your peace' part," Steve McMahon, a former Dean adviser, said of Clinton's strength in October.

But soon there were signs of trouble for her.

An internal campaign memo had surfaced the previous May in which aides urged Clinton to bypass the leadoff caucuses in Iowa because it was her "consistently weakest state." Clinton disavowed the idea and worked hard all fall for an Iowa win, but the memo rang true. She was walloped with a third-place showing in Iowa, surpassed by both Obama and Edwards.

"Years from now," Obama promised his Iowa supporters, "you'll look back and you'll say that this was the moment. This was the place where America remembered what it means to hope."

His Iowa victory propelled him like a slingshot into New Hampshire, where the only question seemed to be how big his victory would be.

Clinton didn't buy it, and neither did the public.

With her candidacy on the ropes, tough-as-nails Clinton let loose her emotions. Choking back tears the day before the primary, Clinton spoke from the heart about the meaning of the presidential race. In the process, she softened her remote image and zinged Obama along the way.

"You know, this is very personal for me," she told voters in a coffee shop. "Some of us are right, and some of us are not. Some of us are ready, and some of us are not."

It was a powerful moment, played over and over on TV.

When the New Hampshire results came in, Clinton was the newest comeback kid, Obama the underdog once again.

"I found my own voice," Clinton declared.

Then she overplayed her hand, or rather, her husband.

Heading into a difficult South Carolina contest, Bill Clinton ramped up the anti-Obama rhetoric he'd first unleashed in New Hampshire.

The ex-president's rancorous words _ criticizing Obama's positions on the Iraq war as a "fairy tale" and complaining that the Obama campaign had put out a "hit job" on him _ were a distasteful counterpoint to Obama's lofty message.

Obama, for his part, took the criticism as a source of pride. "It means I might win this thing," he said.

Win he did in South Carolina. And the money came pouring in.

Obama collected a stunning $36 million in January, compared with $14 million for Clinton.

That gave him the firepower to challenge Clinton everywhere in the mega-round of primaries on Super Tuesday, the day that Clinton had once predicted would be the "finish line."

Instead they traded states, victory for victory, on Feb. 5, and neither came close to touching the tape.

And from there, it was all Obama, all the time, rolling up 11 straight primary and caucus victories in the past three weeks.

Clinton responded by moving the finish line _ and raising her own boatload of cash. She collected $35 million in February but was surpassed yet again by Obama's fundraising.

Now Clinton is pinning her hopes on victories Tuesday in Ohio and Texas, where she once led in polls by a wide margin.

But the race has tightened in both states, and Clinton for the first time has lost the lead that she has held in national polls since Day One.

The news just gets worse for her. Two weeks ago, she was up by 16 points in Pennsylvania, which votes April 22. A poll this week showed the race at Clinton 49, Obama 43.

With every victory, more voters have given Obama a closer look.

"The person who wins homecoming queen always looks a lot better the following week walking around campus," said Hart, the pollster.

"My cautionary note," he added, "is that it ain't over. You always think the surprise you've seen is the last surprise."

Americans on road: 1.65 trillion miles

DETROIT (UPI) Americans drove a record 1.65 trillion miles lastyear, boosting over-all vehicle ownership and operating costs by 10.4percent to a record high of $779.1 billion, a study showed yesterday.

The study, made annually by Hertz Corp., said that for the firsttime, over-all ownership and operating costs for trucks topped thoseof cars, partly because of the surging popularity of light trucks andminivans.

Passenger car costs alone climbed 7.2 percent to $379.3 billionas the number of cars on the road rose 2.2 percent to 128.6 million,double last year's rise.

The study showed that per-auto costs in 1985 amounted to $2,950,up $136 from 1984. Lower fuel prices and interest rates reducedmotorists' annual costs by $29, but higher repair, maintenance andinsurance costs and miscellaneous fees added $165, resulting in thenet increase.

Total truck outlays amounted to $399.8 billion, up 13.7 percentfrom the year before. Truck outlays last year rose 4.6 percent to$9,519 per unit or 78.9 cents per mile, up from $9,104 or 78.8 centsin 1984, the study showed.

There were 8.8 percent more trucks on the road last year than in1984 as sales of new commercial vehicles reached a record 4.67million units. In all, the nation's truck population was 42 millionlast year.

The latest auto figures, which cover cars of all ages and sizes,translate into a per-mile cost of almost 33.2 cents. Last February,a Hertz study said ownership and operating costs for a typicalcompact car bought new and driven 10,000 miles per year for fiveyears cost 47.6 cents a mile to run, up from 45.7 cents a mile in1984.

The study said that since 1972 the average car ownership andoperating costs have risen 125 percent. This compares with a 157percent rise in inflation and a 191 percent jump in personal income.Average new car prices rose 199 percent in that same period.

Help scarce for refugee rape victims in Jordan

A New York-based refugee advocacy group says Iraqi refugee rape victims in Jordan receive little medical care.

Sarah Chynoweth of the Women's Commission for Refugee Women and Children says emergency contraception and treatments that help reduce exposure of HIV are not available in Jordan. She spoke Monday during a visit to the Jordanian capital, Amman, to review the health situation.

She could not provide statistics on rape in Jordan because of the taboo associated with sex outside marriage in the socially conservative Muslim country.

But she says the issue is of concern because displaced Iraqi women are "more vulnerable to rape" due to their illegal status. Many are fearful of reporting rape to police and family members.

Pentagon `crackdown' is lame

The recent disclosures of mismanagement in the production of theNavy's new carrier-based attack plane - the A-12 Stealth - make youwonder whether defense contractors are working for the taxpayers orthe taxpayers are working for the defense contractors.

You could well get the idea that it's the latter when you readabout how Pentagon inspectors were bossed around by the peoplebuilding the A-12, which is now a year behind schedule and running atleast $1 billion over what it was supposed to cost.

One of the contractors, General Dynamics, ordered governmentinspectors at the company's A-12 plant in Fort Worth to turn overtheir notes to be reviewed for security classification. Theinspectors, incredibly, did as ordered. The upshot was that one setof notes was lost.

"We question any procedure by which a contractor obtains accessto, and control over, the work product of government personnelengaged in oversight duties," said an internal Navy report in a bitof an understatement.

Apparently the notion that the government - meaning U.S.citizens - is supposed to be in charge is not common in the Pentagon.

The report especially noted how John A. Betti, theundersecretary of defense for acquisition and the Pentagon'sthird-ranking official, too easily took the contractors' word thatthe project could be completed on time and within cost, whenlower-level Pentagon officials were warning otherwise.

Hey, no skin off Betti's back. He'll help out in a review ofwhat went wrong.

But why should we expect any punishment for Betti when you seewhat happened to the high military officials who were in charge?

True, the vice admiral who ran all Navy acquisition programs wasforced by the Navy to retire two years early. We suspect, though,that most people would be able to survive quite comfortably on athree-star admiral's retirement pay.

Then we have the rear admiral who is the executive officer fortactical aircraft programs and the captain who is the A-12 programmanager who simply will be reassigned and receive letters ofreprimand.

Just how serious is that? The captain still gets his promotion,as scheduled, to rear admiral.

Somehow, we're supposed to think the Pentagon is really crackingdown on these people. We're told this is the first time that anymilitary service has relieved top managers of a major weapons systemas it was being developed and manufactured.

But considering the Pentagon's acquisition track record, we'vegot to wonder what took them so long to do even this much.

WHO says swine flu cases in 46 countries

The World Health Organization says Honduras, Iceland and Kuwait have become the latest countries to confirm cases of swine flu.

The organization says 46 countries have now reported a total of 12,515 cases and 91 deaths.

About half of all cases are in the United States.

WHO says Honduras and Iceland each have one case. Kuwait's 18 cases have been reported on a U.S. military base.

WHO's tally shows that Mexico has reported 282 new cases and five deaths since Saturday.

Mass AG reaches final Big Dig accident settlements

The Massachusetts attorney general announced final settlements with two companies involved in the Big Dig project on Thursday, concluding the state's litigation in a 2006 tunnel ceiling collapse that killed a Boston woman.

Attorney General Martha Coakley said Gannett Fleming had agreed to pay $1.5 million to help maintain the Big Dig tunnels in the future.

The Camp Hill, Pa.-based company, which designed the ceiling, will also pay $50,000 to the city of Boston and forgo $150,000 in payments from the Massachusetts Turnpike Authority.

Coakley also reached a settlement agreement with Sika Corp., of Lyndhurst, N.J. It made the epoxy glue used in the ceiling that collapsed. Sika sold the product to Powers Fasteners Inc., which has already settled.

Sika has agreed to pay $200,000 into the trust fund, which is being used for upkeep on the $15 billion tunnel complex.

Coakley said she was dismissing claims against Sigma Engineering International Inc., a Lincoln, R.I., structural engineering company, and Conam Inc., a materials inspection company, after finding the corporations were not liable for the ceiling collapse.

"The resolutions we have reached with the various companies involved in the project appropriately hold accountable those responsible for the problems in our tunnels, ensure that similar problems will be prevented in the future and provide the commonwealth with the necessary funds to maintain the tunnels and other transportation infrastructure in the years ahead," Coakley said in her statement.

Coakley, a potential candidate for U.S. Senate, also described the litigation as a priority of hers since taking office in 2007.

Milena Del Valle, 39, was killed and her husband injured when their car was crushed by tunnel ceiling panels that fell as the couple drove to Logan International Airport in July 2006.

The accident prompted a shutdown of a series of tunnels and ramps, a review of every bolt in the system and a series of civil and criminal litigation.

Investigators concluded the panels fell after the failure of epoxy used to hold metal attachment bolts into the concrete tunnel ceiling. The type of epoxy used was not intended for that purpose.

Police said two people were shot Monday night on Hamilton Hill, one a 9-year-old boy who was an unintended victim.

Lt. Brian Barnes said the youth was coming out of a convenience store at Craig and Emmett streets around 7:15 p.m. when a gunman tripped over him while shooting at another man.

Thai tourism officials seek to minimize impact of unrest in south.

Nov. 4--Deputy Prime Minister Suwat Liptapanlop has called on public and private tourism-related agencies to jointly minimise the impact of the unrest in the South on the tourism industry.
